BENNINGTON SELECT BOARD MEETING BENNINGTON FIRE FACILITY 130 RIVER STREET BENNINGTON, VERMONT 05201 MONDAY, FEBRUARY 8, 2010 MINUTES BOARD MEMBERS PRESENT: Lodie Colvin-Chair; Sharyn Brush-Vice-Chair; John Zink; Jason Morrissey; Joseph Krawczyk; Chris Oldham and Matt Maroney. ALSO PRESENT: Stuart Hurd-Town Manager; Dan Monks-Planning Director and Nancy Lively-Recording Secretary. At 7:00 P.M., Lodie Colvin called the meeting to order. 1.MINUTES - JANUARY 23, 2010 MINUTES - JANUARY 25, 2010 Sharyn Brush moved and Chris Oldham seconded to approve the Minutes of January 23, 2010 as presented. The motion carried unanimously Sharyn Brush moved and Chris Oldham seconded to approve the Minutes of January 25, 2010 as presented. The motion carried with Joseph Krawczyk abstaining. 2. WARRANTS The warrants were circulated for signatures after Mr. Hurd answered Board questions on W.B. Mason office supplies, H&L Fuel Company, fuel pricing and graffiti removal. 3. CITIZENS None. 4. SIGN ORDINANCE APPROVAL Mr. Monks noted the following Sign Ordinance revisions that were requested by the Board: • Page 3, Article 2-3 General Regulations, A. Prohibited Signs, o 1. Line 3, Delete "30 days" and Add "one year". o 1. Line 4, Add "Provided; however, that such signs may remain if legally existing prior to closure of the business, and such signs comply with this ordinance, as amended from time to time, in all respects." • Page 10, Article 2-4 Structural Regulations, A. Maintenance, o Line 4, Change "30" to "60". • Page 11, Article 2-4 Structural Regulations, D. Setback, o Line 3, Add "Provided, however, that such signs and supporting structures located in the CB Zoning District shall comply with the building setback requirements for the CB District." • Page 11, Article 2-5 Non-Conforming Signs, o Line 2, Change "be brought" to "be considered non-conforming signs". o Line 2, Delete "brought into compliance within five years after the adoption date of this ordinance. If such signs are found not to conform on or after the date that is five years after the adoption date of this ordinance, they shall be brought into compliance upon notice from the Zoning Administrator unless an appeal is filed as provided for in Article 2-7 of this ordinance." o Line 2, Add "A non-conforming sign may remain in place until removed, altered, resurfaced or relocated. All new signs shall comply with this ordinance in all respects, and all existing signs (including non-conforming signs) that are altered (including any change in text, logo, color, etc.), resurfaced or relocated" o Line 11, Delete "If any existing sign on a premises is altered, resurfaced or relocated, or if any new sign is erected on a premises, such sign, and all other signs on the premises shall be brought into compliance or removed prior to such alteration, resurfacing or relocation of an existing sign or such erection of a new sign." Mr. Morrissey asked about Page 9, Article 2-3, General Regulations, G. Historic or Architecturally Significant Signs, and Mr. Monks replied that none presently exist. Joseph Krawczyk moved and Matt Maroney seconded to approve the Proposed Revised Sign Ordinance as presented. The motion carried unanimously. Mr. Krawczyk asked about the status of the Town Plan, and Mr. Monks answered the draft of the Town Plan would be ready for review in March 2010. 5. BENNINGTON'S ANNUAL FINANCIAL PLAN FOR HIGHWAY SPENDING Mr. Hurd circulated the Bennington's Annual Financial Plan-Town Highways for signatures. 6. 2010 LIQUOR AND TOBACCO LICENSE APPLICATIONS The 2009 Second Class Liquor & Tobacco License Application, the 2010 Liquor License Renewal Applications and the 2010 Tobacco License Renewal Applications Approval Sheet was circulated for signatures on the following: 2009 Second Class Liquor & Tobacco License Application w 2nd Class & Tobacco License 1.Mincer's Mini Mart (required due to a corporate change only) 2010 Liquor License Renewal Applications - First Class Renewals 1.Bennington College 2.Bennington College Commons 3.Four Chimneys Inn 4.Your Bellys' Deli 2010 Liquor License Renewal Applications - Second Class Renewals 1.Maruti, Inc. 2.North Bennington Variety 3.Rite Aid #10314 2010 Tobacco License Renewal Applications 1.Maruti, Inc. 2.North Bennington Variety 3.Rite Aid #10314 7. MANAGER'S REPORT Mr. Hurd circulated the Fairpoint Pole permit to replace six poles and possibly associated guide wires along the easterly end of Main Street for signatures. Mr. Hurd reminded everyone that the Annual Meeting is on March 1, 2010 with voting on March 2, 2010. The Select Board meeting on March 8, 2010 will take place at the Town Office at 5:30pm with the March 22, 2010 meeting to take place at the Fire Facility as normally scheduled. 8. OTHER BUSINESS Mr. Krawczyk reminded everyone that the Department of Motor Vehicles has moved to Depot Street. 9. EXECUTIVE SESSION A.PERSONNEL B.CONTRACT At 7:17 P.M., Chris Oldham moved and John Zink seconded to go into Executive Session to discuss Personnel and a Contract. The motion carried unanimously.
